TERMS AND CONDITIONS OF THE CONTEST

" Fore Court Tech 2023 " (the "Contest")

The official rules, as well as the terms and conditions applicable to the Contest (hereinafter, the "Terms and Conditions"), are set out below.

Any person participating in the Contest accepts the provisions described in the Terms and Conditions and privacy policy. If you do not agree with the Terms and Conditions, do not participate in the Contest.

1. Organizer

The entity Visa Europe Management Services Spanish branch, with address at Plaza Pablo Ruiz Picasso, 1, Torre Picasso, Planta 16, 28020 and CIF W8264041H (hereinafter, "Visa"), will carry out the Contest in accordance with the Terms and Conditions.

2. Participation in the Contest

Individuals over 18 years old attending the Fourt Court Tech 2023 Event taking place in Alicante, Spain on October 16, 17 and 18, 2023 (hereinafter, the “Event”) may participate in the Contest. Visa employees or their immediate family members, or those directly or indirectly involved in the organization or execution of the Contest, are not eligible to participate in the Contest. Likewise, Visa reserves the right to exclude any user from participation if it considers that the rules of these Terms and Conditions or their nature and motivation have not been fully or partially complied with.

On October 16, attendees will be handed on arrival to the Event a flyer and a QR code with the Terms and Conditions and instructions on how to enter the Contest.

In order to participate in the Contest, eligible individuals must: (i) be an attendee of the Event; and (ii) respond to the question “Visa is transforming payments in mobility because…”. Eligible participants must send their submissions to [email protected] before October 17 at 19:30 local time.

The organizer will announce the winners of the Contest on October 18, 2023, in accordance with the provisions of the Terms and Conditions. Visa will announce the name of the winners during the Event and on its social networks.

3. Prizes

Visa will choose at its discretion the most accurate answer from among all the answers provided by participants who comply with the Terms and Conditions.

The winner of the first Prize will receive a one-night (breakfast included) package to the Olympics Paris 24 for two people (flights not included), tickets to the swim event on the 3rd - 4th August 2024 (at Visa’s discretion), a €200 Visa prepaid card to cover expenses of the trip, Paris activity pass, Metro pass, drinks voucher (for hotel), guest registration, access to a local hosting team, access to Visa event, medical and security team and Olympics Paris 24 merchandise pack. Two runners-up will receive Olympics Paris 24 merchandise pack, including one backpack, one power bank, one notepad and one pen. 

Each participant may be awarded only once. The first Prize has a value of 3845 euros. Each runner-up merchandise pack Prize has a value of 95 euros. The Prizes do not include any additional expenses or charges other than their delivery to the winners, so Visa does not assume any costs associated with attending the experience or enjoyment of the Prizes (by way of example but not limitation, the Prize does not include the payment of flights or transfers).

Winner of the first Prize may not request changes or modifications if the date and time of the tickets that correspond to them do not match their preferences or availability. Winners may forfeit the Prize in case the date and time do not fit their preferences. The Prizes are not exchangeable, refundable or substitutable for another prize or for its monetary value. The winners agree not to resell the Prizes. 

In the event of force majeure, Visa reserves the right to substitute the Prize for a Prize of equal value and characteristics (or greater).

 

4. Fraud

In the event that Visa detects any anomaly or suspects that a participant is preventing the normal development of the Contest, illegally altering their participation through any procedure, whether technical or computer, it may unilaterally disqualify said participant. Visa has enabled the necessary technological measures to detect fraudulent, anomalous or intentional actions that seek to alter the mechanics of the Contest or obtain a Prize illegally or in violation of the Terms and Conditions.

5. Acceptance of the Terms and Conditions

Participation in the Contest implies acceptance of the Terms and Conditions, available at the following links, visa.co.uk/terms/forecourttech.html and visa.es/terms/forecourttech.html Failure to comply with the Terms and Conditions will result in the automatic disqualification of participation in the Contest.

All Participants hereby authorize Visa to mention and use their names and record them, if applicable, for the purpose of announcing the winners of the Contest through a video posted on social media, and waive any compensation in consideration, whether in cash or in kind. In addition, entrants entice Visa to disclose and publicize their participation in the Contest through any means and in such manner as Visa deems appropriate. 

Provided that it does not involve a substantial alteration, reduction or impairment of the essential conditions of the Contest, Visa may modify its duration, operation, the Prizes and other characteristics and conditions and, where appropriate, any modification will be communicated in a timely manner through the same system that Visa has used to advertise the Terms and Conditions.

6. Processing of Personal Data

The data of the participants in the Contest (including, where appropriate, images) will be treated in accordance with the applicable regulations on data protection and, specifically, in accordance with Spanish regulations (Organic Law 3/2018, of December 5, on Data Protection and guarantee of digital rights, hereinafter "LOPDGDD") and European (EU Regulation 679/2016, "GDPR") for the protection of personal data.

The data controller is Visa Europe Management Services, Spanish Branch, with address at Plaza Pablo Ruiz Picasso, 1, Torre Picasso, Planta 16, 28020.

The data will be processed in order to manage the development of the Contest and the delivery of the Prizes object of the Contest, contact the winning participants, communicate the Prize, and, if expressly consented, for the purpose of sending advertising or commercial prospecting of Visa products, services and activities.

Visa will establish the technical and organizational measures necessary to guarantee security in the processing of the data provided for in these Terms and Conditions. Only third parties to whom Visa is legally obliged to provide it (such as banks or tax authorities) and companies entrusted with the provision of services related to the Contest will have access to personal data.

Visa will process the personal data of the participants for the duration of the Contest and the proper management of the delivery of the Prize. Likewise, Visa will keep the data for the time necessary to comply with the legal obligations that in each case correspond according to each type of data.

Participants may exercise at any time, the rights of access, rectification, cancellation or opposition, limitation of treatment, portability and revocation of consent in relation to the purpose of sending advertising. For this purpose, they must send a written request to the following email address: [email protected], indicating the request in which the request is specified. Likewise, they may file a claim with the Spanish Agency for Data Protection.

The indication of the personal data of the winners of the Contest will be mandatory for the management of the Prize. Any false communication of personal data will entitle the organizers of this Contest to disqualify the winners.

7. Exclusion of Liability

Visa will not be responsible for any delays, losses or damages that participants of the Contest may suffer due to causes that are not directly or indirectly attributable to it. By way of example but not limitation, Visa will not be liable for cases of force majeure (e.g. strikes) that may prevent the winner from enjoying all or part of the Prize, or in the event that damages are caused to an entrant during the enjoyment of the Prize.

8. Assignment of Intellectual and Industrial Property Rights

Within the framework of these Terms and Conditions, "Intellectual and Industrial Property Rights" are all the rights recognized in the applicable regulations on intellectual property (exclusive rights, related rights and sui generis rights), industrial property rights (patents, trademarks, utility models, designs and any similar right).

Acceptance of the Terms and Conditions implies the exclusive assignment to Visa, and without any consideration in favour of the participants, of all rights to the comments, content and responses and speech of the winner ("Contributions") done within the framework of the Contest by the participants. Visa may exercise the Intellectual and Industrial Property Rights over the Contributions in the manner it deems appropriate, and may transmit, assign or license them to third parties under the terms and conditions it deems appropriate, without it being necessary to inform the participants or obtain their consent.

The assignment of the Intellectual and Industrial Property Rights over the Contributions is not subject to any temporal or territorial limitation, that is, it covers the entire legal term of the Intellectual and Industrial Property Rights over the Contributions and is made for everyone.

Visa, as the exclusive owner of all Intellectual and Industrial Property Rights over the Contributions, may exercise such rights through any form of exploitation, in any field of activity, whether or not it is the usual activity of Visa, and use any format, medium or support.

Visa may use and exploit the Contributions separately or in conjunction with any other creation it deems appropriate.

The participants declare and guarantee at all times the personal authorship of the Contributions. Participants will hold Visa harmless from any action or claim by third parties for infringement of their Intellectual Property Rights.

9. Fees and Taxes

The organization of the Contest, as well as the delivery of the Prizes, are subject to current tax regulations. In particular, the first Prize is subject to withholdings or payments on account that, in accordance with said regulations, are applicable.

Any other tax or legal burden that the acceptance of the Prize may entail will be borne by the winners.

10. Applicable Law

These bases of participation are governed by Spanish legislation.
