TERMS AND CONDITIONS OF THE COMPETITION

"ITM Conference 2024" competition (the "Competition")

The official rules and terms and conditions (the "Terms and Conditions") for the Sweepstakes are set forth below.

Any person participating in the Competition accepts the provisions described in the Terms and Conditions. If you do not agree with the Terms and Conditions, do not participate in the Contest.

1. Organizer

The Promoter is Visa Europe Limited, a limited liability company incorporated in England and Wales with its registered office at 1 Sheldon Square, London W2 6TT (hereinafter referred to as "Visa").

2. Participation in the Contest

All participants of the ITM Conference 2024 event (hereinafter referred to as the "Event"), which will take place from 23rd to 25th April 2024 in Brighton (UK) and are at least 18 years old at the time of participation, are eligible to participate in the competition.

Employees of Visa, their immediate family members, and persons directly or indirectly involved in the organization or operation of the Sweepstakes are not eligible to participate in the Sweepstakes.

Similarly, Visa reserves the right to disqualify any person from participation if Visa believes that they are not complying with the Terms and Conditions.

Participants of the event will receive a flyer upon arrival on 23rd / 24th April 2024, which can be used to access the terms and conditions of participation and instructions on how to participate in the competition.

To enter the Sweepstakes, Eligible Persons must: (i) be entrants to the Event; (ii) answer the question "How are Visa payment solutions transforming corporate travel?" in English; and (iii) follow the LinkedIn account "Visa Commercial Solutions" with their personal account on LinkedIn include a screenshot of the LinkedIn follow as proof. Eligible entrants must send their entries to [email protected] quoting ‘ITM Brighton 2024 – Visa Competition’ in the subject line by 25th April, 2024 at 12pm. (local time in the UK).

Participation in the competition is free of charge.

3. Prizes

The winner of the first Prize will receive a one-night (breakfast included) hotel package to the Olympics Paris 2024 for two people (transport including flights not included), two tickets to the Olympic diving event on the 31st July 2024 (at Visa’s discretion), a €200 Visa prepaid card to cover expenses of the trip, Paris activity pass for two, Metro pass for two, drinks voucher (for hotel) and Olympics Paris 2024 merchandise pack. 

Two runner-ups will get their hands on exclusive Visa Paris 2024 merchandise.  

Each participant can win a maximum of one prize.

Additional costs associated with claiming the prize (such as travel to and from Paris) are at the expense of the winner. The winner is responsible for any taxation of the prize. 

The winner of the first prize will only be able to claim the prize at the times specified by Visa and will not be able to request any changes if the date and time do not coincide with their wishes or availability. In this case, the prize will be forfeited without replacement. 

Prizes are non-exchangeable, non-refundable or non-refundable with any other prize or its monetary value. Winners agree not to resell the prizes.

In the event of force majeure, Visa reserves the right to substitute the prize with a prize of equal value and characteristics (or higher).

4. Determination of the winners

Out of all the replies submitted to the questions referred to in No. 2, the three best answers will be selected by a jury consisting of three people, who will be presented with the answers in anonymized form. Subsequently, it will be checked whether the respective participants meet the further requirements according to No. 2.

5. Announcement and notification of winners

Visa will announce the winners of the Sweepstakes on April 25th, 2024, in accordance with the terms of the Terms and Conditions. Visa will announce the winner and promote on its social networks. Furthermore, the winners will be notified of the prize via the e-mail address they used to submit their response.

All entrants hereby authorize Visa to disclose and use their names and, where appropriate, to make video and audio recordings of them that may be posted on social media as part of the announcement of the winners of the Sweepstakes and waive any compensation in cash or in kind.

In addition, entrants authorize Visa to publicize and publicize their participation in the Contest in any manner that Visa deems appropriate.

6. Manipulation and other misconduct

Visa reserves the right to exclude from participation any participant who is suspected of manipulation or attempted fraud or who otherwise violates the terms and conditions of participation without giving reasons.

If the conditions for exclusion are met, Visa is entitled not to transfer the prize or to revoke and reclaim it retrospectively.

7. Acceptance of the Terms and Conditions

Participation in the competition implies acceptance of these terms and conditions, which can be accessed at the following link:

Failure to comply with the terms and conditions will result in automatic disqualification from participation in the competition.

8. Changes/Discontinuation of the Competition

Visa reserves the right to modify or discontinue the Sweepstakes in the event of unforeseen circumstances.

In particular, Visa is entitled to discontinue, cancel or suspend the competition if:

  • an attempted misuse through manipulation is detected, or
  • Proper execution is no longer ensured, in particular in the event of hardware or software failure, program errors, computer viruses or unauthorized intervention by third parties, as well as mechanical, technical or legal problems.

9. Privacy

Visa processes the personal data of the participants exclusively for the proper execution and processing of the competition.

10. Limitation

Visa assumes no responsibility for any loss of data, including, but not limited to, loss of data, technical defects, and lost, damaged, or delayed entries due to network, hardware, or software problems.

Otherwise, Visa is only liable for gross negligence or intentional action on the part of its legal representatives, employees or vicarious agents. Furthermore, Visa is not liable for any damages suffered by the winner and/or his/her companion in connection with the prize. The above exclusion of liability does not apply to the extent that liability is mandatory, e.g. in cases of intent, gross negligence, injury to life, body or health or due to the violation of essential contractual obligations, i.e. obligations the fulfilment of which makes the proper execution of the contractual relationship possible in the first place, the violation of which jeopardises the achievement of the purpose of the contract and on the observance of which the participant may regularly rely. However, the claim for damages for the breach of essential contractual obligations is limited to the foreseeable damage typical of the contract, unless liability is incurred for intent or gross negligence or for injury to life, body or health. A change in the burden of proof to the detriment of the participant is not connected with the above provisions. 

Furthermore, Visa is not liable for cases of force majeure (e.g. strikes or natural disasters) that could prevent the winner from claiming all or part of the prize.

11. Granting of rights of use of intellectual property

For the purposes of these Terms and Conditions, "Intellectual Property Rights" means all rights recognised by the applicable regulations on intellectual property and industrial property rights (patents, trademarks, utility models, designs, copyrights and similar rights).

By participating in the competition and accepting these terms and conditions of participation, the participants grant Visa a non-exclusive right of use – including for commercial use – to their submitted answers, other comments, content and speeches of the winner in connection with this competition ("Contributions"), without restriction in terms of content, place and time, free of charge. Visa may exercise the rights granted to the Contributions in such manner as Visa deems appropriate.

Visa may use and exploit the Submissions, either individually or in conjunction with other works it deems appropriate. 

The participants declare and guarantee the personal authorship of the contributions at all times. Entrants indemnify Visa against any action or claim by any third party for infringement of their intellectual property rights.

12. Applicable Law

UK law applies.

13. Other

Legal recourse is excluded.

Should any of these terms and conditions be or become invalid, the validity of the remaining terms and conditions of participation shall remain unaffected.
