TERMS AND CONDITIONS OF THE CONTEST

" GBTA + VDR Europe " (the "Contest")

The official rules, as well as the terms and conditions applicable to the Contest (hereinafter, the "Terms and Conditions"), are set out below.

Any person participating in the Contest accepts the provisions described in the Terms and Conditions. If you do not agree with the Terms and Conditions, do not participate in the Contest.

 

1. Organizer

The entity Visa Europe Management Services Ltd, German branch, with address at Eurotheum, Neue Mainzer Straße 66-68, 60311 Frankfurt am Main, Germany (hereinafter, "Visa"), will carry out the Contest in accordance with the Terms and Conditions.

 

2. Participation in the Contest

Individuals over 18 years old attending the GBTA Hamburg 2023 Event taking place in Hamburg, Germany on November 14, 15 and 16, 2023 (hereinafter, the “Event”) may participate in the Contest. Visa employees or their immediate family members, or those directly or indirectly involved in the organization or execution of the Contest, are not eligible to participate in the Contest. Likewise, Visa reserves the right to exclude any user from participation if it considers that the rules of these Terms and Conditions or their nature and motivation have not been fully or partially complied with.

On November 14/15 2023 attendees will be handed on arrival to the Event a flyer and a QR code with the Terms and Conditions and instructions on how to enter the Contest.

In order to participate in the Contest, eligible individuals must: (i) be an attendee of the Event;  (ii) respond to the question “Visa is transforming payments in mobility because…” in English; and (iii) follow the account “Visa Commercial Solutions” with their personal account on LinkedIn. Eligible participants must send their submissions to [email protected] before November 15 at 12:00 local time.

Participation in the Contest is free of charge.

 

3. Prizes

Visa will choose at its discretion the most accurate answer from among all the answers provided by participants who comply with the Terms and Conditions.

The winner of the first Prize will receive a one-night (breakfast included) hotel package to the Olympics Paris 2024 for two people (transport including flights not included), two tickets to the Olympic swim event on the 29th or 30th July  2024 (at Visa’s discretion), a €200 Visa prepaid card to cover expenses of the trip, Paris activity pass for two, Metro pass for two, drinks voucher (for hotel). and Olympics Paris 2024 merchandise pack.

Two runners-up will receive Olympics Paris 2024 merchandise pack, including one backpack, one power bank, one notepad and one pen.

Each participant may be awarded only once.

Any additional costs associated with claiming the prize (e.g. travelling to and from Paris) shall be borne by the winner. The winner is responsible for paying any taxes on the prize.

The Winner of the first Prize may only claim the Prize at the times specified by Visa and may not request changes or modifications if the date and time do not match their preferences or availability. Winners may forfeit the Prize in case the date and time do not fit their preferences. The Prizes are not exchangeable, refundable or substitutable for another prize or for its monetary value. The winners agree not to resell the Prizes.

In the event of force majeure, Visa reserves the right to substitute the Prize for a Prize of equal value and characteristics (or greater).

 

4. Determination of the winners

A jury consisting of three people, who will receive the answers in anonymised form, will select the three best answers from all the answers submitted to the question mentioned in section 2.  Then it will be checked whether the participants in question fulfil the other requirements set out in section 2.

 

5. Announcement and notification of the winners

Visa will announce the winners of the Contest on November 16 2023, in accordance with the provisions of these Terms and Conditions. Visa will first announce the full name of the winners during the Event. In addition, the winners will be notified of their win via the email address they used to submit their answer.

 

All Participants hereby authorize Visa to mention and use their names and record them, if applicable, for the purpose of announcing the winners of the Contest through a video posted on social media, and waive any compensation in consideration, whether in cash or in kind. In addition, entrants entice Visa to disclose and publicize their participation in the Contest through any means and in such manner as Visa deems appropriate.

 

6. Fraud and other kind of misbehaviour

Visa reserves the right to exclude participants who are suspected of manipulation or attempted fraud or who violate the Terms and Conditions in any other way from participation without giving reasons.

If the conditions for exclusion are met, Visa is entitled not to provide the prize or to subsequently deprive and reclaim it.

 

7. Acceptance of the Terms and Conditions

Participation in the Contest implies acceptance of the Terms and Conditions, available at the following links:

Failure to comply with the Terms and Conditions will result in the automatic disqualification of participation in the Contest.

 

8. Changes/cancellation of the Contest

Visa reserves the right to change or cancel the Contest in the event of unforeseen circumstances.

In particular, Visa is authorised to discontinue, cancel or suspend the Contest if

  • attempted misuse through manipulation is detected, or
  • proper implementation is no longer ensured, in particular in the event of hardware or software failure, program errors, computer viruses or unauthorised interventions by third parties as well as mechanical, technical or legal problems.

9. Processing of Personal Data

Visa processes the personal data of the participants exclusively for the proper realisation and processing of the competition.

10. Limitation of Liability

Visa accepts no responsibility for loss of data, in particular data lost during data transmission, technical defects or lost, damaged or delayed submissions due to network, hardware or software problems.

Furthermore, Visa is only liable for gross negligence or wilful acts of its legal representatives, employees or vicarious agents. Furthermore, Visa is not liable for damages incurred by the winner and/or his/her companion in connection with the prize. The above exclusion of liability shall not apply where liability is mandatory, e.g. in cases of wilful intent, gross negligence, injury to life, limb or health or breach of material contractual obligations, i.e. obligations whose fulfilment is essential for the proper performance of the contractual relationship, whose breach jeopardises the achievement of the purpose of the contract and on whose compliance the participant may regularly rely. However, the claim for damages for the breach of essential contractual obligations is limited to the foreseeable damage typical for the contract, unless liability is assumed for intent or gross negligence or due to injury to life, limb or health. The above provisions do not imply a change in the burden of proof to the detriment of the participant.

Further, Visa will not be liable for cases of force majeure (e.g. strikes) that may prevent the winner from enjoying all or part of the Prize, or in the event that damages are caused to an entrant during the enjoyment of the Prize.

 

11. Assignment of Intellectual and Industrial Property Rights

Within the framework of these Terms and Conditions, "Intellectual and Industrial Property Rights" are all the rights recognized in the applicable regulations on intellectual property (exclusive rights, related rights and sui generis rights), industrial property rights (patents, trademarks, utility models, designs and any similar right).

By participating in the Contest and thereby accepting these Terms and Conditions, participants grant Visa a non-exclusive right of use - also for commercial use - to the answers, other comments, content and speeches submitted by the winner in connection with this Contest ("Contributions"), which is unlimited in terms of content, location and time and is free of charge. Visa may exercise the Intellectual and Industrial Property Rights over the Contributions in the manner it deems appropriate.

Visa may use and exploit the Contributions separately or in conjunction with any other creation it deems appropriate.

The participants declare and guarantee at all times the personal authorship of the Contributions. Participants will hold Visa harmless from any action or claim by third parties for infringement of their Intellectual Property Rights.

 

12. Applicable Law

German law shall apply.

 

13. Miscellaneous

Legal action is excluded.

Should any of these conditions be or become invalid, this shall not affect the validity of the remaining conditions of participation.
