1. By entering ‘Visa University’ Promotion (the “Promotion”) you agree to be bound by these terms and conditions (“Terms”). Please note that your personal information will be used in accordance with applicable data protection legislation and our Privacy Notice. To view our Privacy Notice please visit Visa’s Privacy Centre at: https://www.visaeurope.com/privacy/. We will only use your personal information for the administration of the Promotion and for no other purpose unless we have an appropriate legal basis (such as your consent) to do so. We will only share your Personal Information with our fulfilment partners for the purposes of and in order to fulfil this Promotion.
2. The ‘Visa University’ Promotion is open to Visa consumer cardholders aged 18 years or older, paying University tuition fees of £1,000 or more, at a university in the United Kingdom (excluding Northern Ireland) with their Visa card on a participating University website (“Qualifying Purchase”)
3. Entrants must either be a full-time student at a University based in the United Kingdom (excluding Northern Ireland), who have had their University offer accepted or the person paying on behalf of such a student. International students must hold an appropriate residency permit/visa, allowing them to stay and study in the United Kingdom.
4. One entry permitted per Qualifying Purchase on a Visa card, a person may be entered multiple times, but must prove that they have a Qualifying Purchase for each entry. A person may only win one prize. If a second prize is won, it will be reallocated to another entrant who will be drawn in accordance with these terms and conditions.
5. Employees and their immediate families, of Visa (the “Promoter”), its agents or anyone professionally connected to this promotion may not enter. Bulk entries, or entries sent through trade, consumer groups, agents or third parties will not be accepted.
6. The Promotion will be communicated via the WPM payment portal, which can be accessed from participating universities’ payment pages. Once a potential entrant selects to pay £1,000 or above of tuition fees they will be offered the opportunity to “opt-in” to the Promotion. (see clause 9 for entry details).
7. All entries must be made by the person entering the Promotion. Anyone trying to circumvent this rule by using alternative details will be disqualified from this Promotion. Bulk entries made from trade, consumer groups or third parties will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’ or any other automated means, that person’s entries will be disqualified and any Prize award will be void. Syndicated entries or those made using methods such as a computer macro, script or the use of automated devices or processes are not allowed and all such entries will be disqualified and any Prize won will be null and void. In the event that the Promotion is subject to any form of multiple entry activity or other abuse, either as described above or by way of other mechanisms, the Promoter reserves the right to include additional fields on the entry page of the Promotion’s website. Such added fields will only require entrants to provide verification information that they are obliged to retain under these Terms to claim any Prize.
8. The Promotion will be open to all of those who opt in to the Promotion between 9am BST on the 1st August 2018 and 11am BST on the 26th September 2018 (“Promotion Period”). All entries entered outside of the Promotion Period, will not be accepted as valid entries.
9. Entrants will enter the Promotion by:
   • Choosing to pay for their University tuition fees on-line on a participating University website, following the relevant instructions on the University website
   • Opting in to enter the Promotion by ticking the relevant box on their screen.
   • Agreeing to the Promotion terms and conditions by ticking the relevant box on their screen.
   • Entering all relevant details which will be used to communicate with entrants to confirm entry and winners to notify them of the win.
   • Making a successful Qualifying Payment of £1,000 or more with their consumer Visa card – for clarity this means the payment must have cleared for the entry to be submitted
   • Entrants will receive an e-mail confirmation advising that if their payment has cleared their entry will be submitted – entrants should look out for this e-mail and check their junk folder regularly.
10. There will be 8 (eight) prize draws, with 2 (two) winners drawn per draw, 2 (two) each week as detailed in clause 11 below.
11. There will be 2 (two) £5,000 payments to be awarded weekly, to each of the winners. There will be 16 (sixteen) £5,000 payments to be won in total across the Promotion (the “Prize”).
12. Winners will be drawn on the following dates and will include all valid entries submitted up until 48 (forty eight) hours before each draw (12 noon BST two days before the draw as detailed below). All valid entries made during the Promotional Period will be entered into each prize draw. The prize draws will take place on the following dates:
    • First draw: 10 August 2018 at 12 noon BST
    • Second draw: 17 August 2018 at 12 noon BST
    • Third draw: 24 August 2018 at 12 noon BST
    • Fourth draw: 31 August 2018 at 12 noon BST
    • Fifth draw: 7 September 2018 at 12 noon BST
    • Sixth draw: 14 September 2018 at 12 noon BST
    • Seventh draw: 21 September 2018 at 12 noon BST
    • Eighth draw: 28 September 2018 at 12 noon BST
13. Winners will be randomly selected by an independent adjudicator weekly from a database of valid entrants.
14. Winners will be notified of their win via e-mail. The confirmation email of the win will be sent on the day following the relevant prize draw (“Winning Email”).
15. To claim their Prize each Winner will need to reply to the Winning Email in order to accept their claim. Winners will be subject to a verification process and will need to supply personal information for the purpose of prize fulfillment only. Each Winner has 30 (thirty) days from the date of the Winning Email was sent to accept their Prize, otherwise the prize will be re-allocated to a runner up prize winner.
16. The Promoter reserves the right to disqualify any entrant reasonably suspected by the Promoter of cheating, behaving fraudulently or acting dishonestly or otherwise acting contrary to the terms and conditions of the promotion. The Promoter also reserves the right to ask for proof of payment in these exceptional circumstances.
17. Please allow 28 days for validation and payment of the prize. This will be paid into the bank account associated with the Visa payment made for the entry.
18. LIMITATIONS OF LIABILITY
    
    18.1 So far as is permitted by law, the Promoter and its associated companies and agents exclude responsibility and all liabilities arising from any act or default by a Winner resulting in the Winner being unable to activate the Prize and/ or any elements of it) which are beyond the Promoter’s reasonable control, including (without limitation) communications failure with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this Promotion, inaccessibility, unavailability or any kind of failure of the internet, any relevant website, mobile phone network, any software, any hardware or any combination thereof.
    
    18.2 The Promoter will not be held liable to any participant for any fraud committed by any third party, the performance of any contractual or other obligations of any third parties associated with the Prize nor for any events beyond its control.
    
    18.3 The Promoter accepts no responsibility for entries not received, not delivered, incomplete, indecipherable, or not in accordance with the entry instructions. No responsibility will be accepted for any entries that are delayed or that are unable to be sent due to lack of network coverage, operator error, or for any other reasons beyond its control. Promoter must receive an entry for it to be valid – proof of sending entries will not constitute deemed entry.
    
    18.4 Nothing in these Terms in any way limit the Promoter (or any other person’s or organisation’s) liability for (i) fraud, or (ii) death or personal injury caused by its own negligence.
    
    18.5 The prizes are awarded at the Promoter’s discretion and are subject to availability. No alternatives are available to the prizes, which are non transferable and non exchangeable. The Promoter reserves the right to substitute the prizes with alternative prizes and free gifts of equal or greater value if outside the reasonable control of the Promoter.
19. GENERAL
    
    19.1 The Promoter's decision is final and binding in all matters relating to the Competition.
    
    19.2 The Promoter reserves (in its sole discretion and so far as is legally permissible) the right to verify, using all reasonable means available to it, whether an entrant is eligible and/or whether a winning entry is valid. If there is any reason to believe that there has been a breach of these Terms or of the spirit of the Promotion, the Promoter may, at its sole discretion, refuse to accept an entry and, if necessary, re-allocate any Prize won in accordance with the procedure outlined above.
    
    19.3 Entrants hereby represent and warrant that each Entry they submit to the Promotion shall comply with these Terms, and: (i) does not violate any applicable local state, provincial, national or international law or include any content that would encourage or provide instructions for a criminal offence; (ii) does not contain any known virus, trojan horse, worm, trapdoor or similar software that may in any way infect or affect any of the Promoter’s hardware or software systems.
    
    19.4 The Winner, by accepting his/her Prize, consents to the Promoter (in its sole discretion) publishing his/her name, county, photograph and any statements made by or attributed to him/her in relation to the Prize or Promotion on the www.visa.co.uk website and in any print, Instagram, Twitter @VisaUK, Visa Facebook page, point of sale or other public relations materials related to the Promotion for advertising and publicity purposes, without additional remuneration. The Promoter may require a Winner to provide this consent in writing to the Promoter prior to receiving their Prize.
    
    19.5 The name and county of the Winners may be obtained by sending a self-addressed stamped envelope to ‘Visa University Promotion”, PO Box 100, Blackburn, BB1 3BW.
    
    19.6 The Promoter reserves the right to terminate or temporarily suspend this Promotion in the event of technical or other difficulties that might compromise its integrity but will always endeavour to minimise the effect on participants.
    
    19.7 Whenever an entrant submits any information to the Promoter, please be aware that the Promoter may store and process this information in different countries from where the entrant resides, including in the US. Please note that these countries may have different laws and requirements about privacy and data use than where the entrant is resident. If the Promoter processes or transfers any personal information of an entrant outside the European Economic Area, the Promoter will do so in full compliance with EU data privacy laws.
    
    19.8 In the event of unforeseen circumstances outside its reasonable control, and where circumstances make this unavoidable, the Promoter reserves the right to modify these Terms prior to the end of the Promotion Period.
    
    19.9 Visa Europe Limited (other than in respect of any liability for negligence causing death or personal injury) are not liable for anything arising out of this Promotion and shall not be liable for any loss or damage whatsoever which is suffered or sustained as a result of participation in the Promotion or acceptance of the Prize.
    
    19.10 All of Visas’s names, logos, and marks appearing in this site or as part of this promotion are trademarks owned by Visa. The use or misuse of these trademarks or any other content of this site is strictly prohibited, except as otherwise permitted herein.
    
    19.11 This Promotion, and any dispute or claim arising out of or in connection with it, shall be governed by and construed in accordance with English law. You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Competition.
