TERMS AND CONDITIONS OF THE COMPETITION

"NextGen Nordics 2024" competition (the "Competition")

The official rules and terms and conditions (the "Terms and Conditions") for the Competition are set forth below.

Any person participating in the Competition accepts the provisions described in the Terms and Conditions. If you do not agree with the Terms and Conditions, do not participate in the Competition.

1. Organizer

The promoter is Visa Europe Limited, a limited liability company incorporated in England and Wales with its registered office at 1 Sheldon Square, London W2 6TT ("Visa" or the “Promoter”).

2. Participation in the competition

All participants of the NextGen Nordics 2024 event (the "Event"), which will take place between 09:30 (Swedish time) and 16:30 (Swedish time) on 23 April 2024 (the “Promotion Period”) in Stockholm (Sweden), and are at least 18 years old at the time of participation, are eligible to participate in the Competition.

Employees of Visa and its group companies, their immediate family members (parents, spouse, children, siblings, grandparents, and grandchildren), and persons directly or indirectly involved in the organization or operation of the Competition are not eligible to participate in the Competition. This Competition is not open to any person who appears on any sanctions list at any time during the Promotion Period.

Similarly, Visa reserves the right to disqualify any person from participation in the Competition if Visa believes that they are not complying with the Terms and Conditions.

Participants of the Event will receive a flyer and a QR code upon arrival on 23 April 2024, which can be used to access the Terms and Conditions of participation and instructions on how to participate in the Competition.

To enter the Competition, entrants must: (i) be entrants to the Event; (ii) answer the question "Visa is revolutionising global money movement by..." in English; and (iii) follow the LinkedIn account "Visa Commercial Solutions" with their personal account on LinkedIn. Eligible entrants must send their entries to the [email protected] email address by 24 April 2024 at 17:00 (local time in Sweden).  

Participation in the competition is free of charge.

3. Prizes

The winner of the first Prize will receive a one-night (breakfast included) hotel package to the Olympic Games Paris 2024 for two people (transport including flights not included), two tickets to the Olympic Games Paris 2024 swim event on the 28th July 2024 (at Visa’s discretion), a €100 Visa prepaid card to cover expenses of the trip, Metro pass for two, airport/train transfers in Paris (via Motorcoach), daily breakfast and light snacks at the hotel, access to Visa event, medical and security support staff and Olympic Games Paris 2024 merchandise pack.

The two runners-up will receive a merchandise pack from the Olympic Games Paris 2024 that includes a backpack, a hoodie, a notepad and a pen.

Each participant can win a maximum of one prize.

Additional costs associated with claiming the prize, including but not limited to: travel to and from Paris, meals and activities outside of the scheduled program itinerary, hotel incidentals and passport and travel visas are at the expense of the winner. Any tax on the prizes is paid by the winner.

The winner of the first prize will only be able to claim the prize at the times specified by Visa and will not be able to request any changes if the date and time do not coincide with their wishes or availability. In this case, the prize will be forfeited without replacement. 

The prize is not negotiable and the winners/recipients must not re-sell or transfer the prize in any way, unless otherwise approved. In the event of the prize being unavailable Visa reserves the right to substitute it for one of equal or greater value. Any substitution will be within the entire discretion of Visa.

In the event the winner does not accept the substitution they will forfeit their right to the prize. So far as is permitted by law, the International Olympic Committee and Paris Organising Committee for the Olympic and Paralympic Games Paris 2024 (the “Rights Holder”) and Visa and their associated companies and agents exclude responsibility and all liabilities arising from: (i) any postponement, cancellation or material change of the promotion of the Olympics - Olympic and Paralympic Games Paris 2024 (the “Sponsorship Event”); and (ii) any act or default by a winner or their guest resulting in the winner or their guest being unable to activate the prize and/ or any elements of it. 

Prizes are subject to all applicable hotel, ticket, venue, event and carrier/transportation terms and conditions. The winner and their guest must comply fully with such terms and conditions and all laws and regulations applicable. Visa will have no liability to the winner or guest if the winner and/or guest are unable to receive the full benefit of the prize or are denied entry to, or are asked to leave, any venue as a result of a failure to abide by the ticket terms, any applicable law or as a result of inappropriate behaviour.

The prize must be accepted as awarded and is subject to all of the applicable terms and conditions prescribed to such prize, including passing necessary sanctions screening.

4. Determination of the winners

Out of all the replies submitted to the questions referred to in paragraph 2 of the Terms and Conditions, the three best answers will be selected by a jury consisting of three people, who will be presented with the answers in anonymized form. Subsequently, it will be checked whether the respective participants meet the further requirements set out under paragraph 2 of the Terms and Conditions.

5. Announcement and notification of winners

Visa will announce the winners of the Competition by April 26, 2024, in accordance with the terms of the Terms and Conditions. Visa will reach out directly to the winners and promote this on its social networks. Furthermore, the winners will be notified of the prize via the e-mail address they used to submit their response. Entrants who have not won will not receive notification that they have not won. By accepting the prize the holder is deemed to have accepted all of the applicable terms and conditions prescribed to such prize, including any entry and COVID-19 requirements.

6. Manipulation and other misconduct

Visa reserves the right to exclude from participation in the Competition any participant who is suspected of manipulation or attempted fraud or who otherwise violates the Terms and Conditions of participation without giving reasons.

If the conditions for exclusion are met, Visa is entitled not to transfer the prize or to revoke and reclaim it retrospectively.

Any attempt to damage or undermine the content or legitimate operation of the Competition is prohibited and may also be a violation of criminal and/or civil laws. The Promoter reserves all its rights and remedies to deal with such action including, without limit, to exclude any entrant or winner believed to be associated with such action.

7. Acceptance of the Terms and Conditions

Participation in the Competition implies acceptance of these terms and conditions, which can be accessed at the following link:

Failure to comply with the terms and conditions will result in automatic disqualification from participation in the Competition.

8. Changes/Discontinuation of the Competition

Visa reserves the right to modify or discontinue the Competition in the event of unforeseen circumstances.

In particular, Visa is entitled to discontinue, cancel or suspend the Competition if:

  • an attempted misuse through manipulation is detected, or
  • Proper execution is no longer ensured, in particular in the event of hardware or software failure, program errors, computer viruses or unauthorized intervention by third parties, as well as mechanical, technical or legal problems.

The Promoter's decision is final and binding in all matters relating to the Competition.

The Promoter reserves the right to terminate or temporarily suspend this Competition in the event of technical or other difficulties that might compromise its integrity but will always endeavor to minimize the effect on participants.

In the event of unforeseen circumstances outside its reasonable control, and where circumstances make this unavoidable, the Promoter reserves the right to modify these Terms and Conditions prior to the closing date.

9. Privacy

Visa processes the personal data of the participants exclusively for the proper execution and processing of the Competition.

Personal information supplied during the course of this Competition may be passed on to third parties including Visa’s associated companies and service providers insofar as required for fulfilment, delivery and arrangement of the prize.

10. Limitation

Nothing in these Terms and Conditions limits or excludes any person’s liability for death or personal injury caused by negligence, for fraud or for any matter for which liability cannot be lawfully limited or excluded. However, to the fullest extent permissible by law, the Promoter (and its associated companies and agents) will not be liable for any loss or damage you suffer as a result of your participation in the Competition and receipt or use of a prize in circumstances where: (i) there has been no breach of a legal duty of care owed to you by the Promoter; (ii) the loss or damage was not caused by a breach of these Terms and Conditions by the Promoter or its agents or representatives; (iii) it was not obvious that you would suffer such loss or damage and nothing you said to the Promoter before you entered this Competition meant that the Promoter should have expected it to happen (so, in the law, the loss was “unforeseeable”); (iv) you could have avoided such loss or damage by taking reasonable action; (v) the loss or damage was caused by an event or circumstance beyond the Promoter’s reasonable control; or (vi) the loss or damage was caused by a third party, including any third party responsible for providing any element of the prize, including hotel and venue operators, event organisers and carriers/transport providers. In addition, the Promoter is not responsible for any business losses you may suffer, such as loss of profits or revenue, loss of anticipated savings or loss of goodwill.   

The Promoter accepts no responsibility for entries not received, not delivered, incomplete, indecipherable, or not in accordance with the entry instructions. No responsibility will be accepted for any entries that are delayed or that are unable to be sent due to lack of network coverage, operator error, or for any other reasons beyond its control. The Promoter must receive an entry for it to be valid – proof of sending entries will not constitute deemed entry.

11. Granting of rights of use of intellectual property

For the purposes of these Terms and Conditions, "Intellectual Property Rights" means all rights recognised by the applicable regulations on intellectual property and industrial property rights (patents, trademarks, utility models, designs, copyrights and similar rights).

By participating in the Competition and accepting these Terms and Conditions of participation, the participants grant Visa a non-exclusive right of use – including for commercial use – to their submitted answers, other comments, content and speeches of the winner in connection with this Competition ("Contributions"), without restriction in terms of content, place and time, free of charge. Visa may exercise the rights granted to the Contributions in such manner as Visa deems appropriate.

Visa may use and exploit entrants’ submissions, either individually or in conjunction with other works it deems appropriate.

The participants declare and guarantee the personal authorship of the contributions at all times. Furthermore, the participants waive all moral rights to the Contributions to the extent permitted by law, including but not limited to the right to be named in relation to Visa’s use of any of the Contributions. Entrants indemnify Visa against any action or claim by any third party for infringement of their intellectual property rights.

By participating in this Competition, you understand and agree that you are not being granted any rights (including any advertising, marketing or sponsorship rights) in relation to the Rights Holder or the Sponsorship Event (or any associated competitions, matches, teams or athletes) and shall not conduct any related marketing or advertising campaigns, promotions or other activities.

12. Applicable law

This Competition, and any dispute or claim arising out of or in connection with it, shall be governed by and construed in accordance with English law. You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Promotion, except that residents of Scotland may also choose for their local courts to have jurisdiction.

13. Other

Should any of these Terms and Conditions be or become invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining terms and conditions of participation shall remain unaffected. Visa’s failure to enforce any term of these Terms and Conditions will not constitute a waiver of that provision.

The Rights Holder is not responsible for the administration of the Competition. The Rights Holder is not liable for anything arising out of this Competition including the fulfilment of any prizes.
